Terms of Service Subscription & Billing Hardware Cancellation Liability Privacy Policy

1. Terms of Service

These Terms of Service ("Terms") govern your use of PhoneGuard, a product of CloudTect ("we," "us," "our"), operated out of London, Ontario, Canada. By subscribing to PhoneGuard, you agree to these Terms in full.

PhoneGuard is a scam detection service designed to help identify and interrupt potentially fraudulent phone calls on residential landlines. It is an assistive tool — not a guarantee of protection.

2. Subscription & Billing

PhoneGuard is offered as a monthly subscription at $44 CAD per month, billed on the same date each month via Stripe. All prices are in Canadian dollars and include applicable taxes where required.

  • A 4-month minimum commitment applies to all new subscriptions. By subscribing, you agree to be billed for at least four consecutive months.
  • After the 4-month minimum, your subscription continues month-to-month with no further obligation.
  • If a payment fails, we will retry automatically and notify you by email. Continued non-payment may result in service suspension.
  • We reserve the right to adjust pricing with 30 days written notice. You may cancel before a price change takes effect.

3. Hardware

PhoneGuard hardware — including the telephone adapter and pre-configured device — remains the property of CloudTect at all times. It is provided for use during your active subscription only.

Your subscription includes the use of professional-grade hardware shipped pre-configured to your address. This equipment has a replacement value of up to $149 CAD.

  • Hardware must be returned within 30 days of cancellation or service termination.
  • Hardware must be returned in good working condition, with all original components.
  • Hardware that is damaged, missing components, or not returned within 30 days is subject to a replacement fee of up to $149 CAD, charged to your card on file.
  • Normal wear from regular use is not considered damage.
  • We will contact you by email to arrange return shipping at no cost to you.

4. Cancellation

You may cancel your PhoneGuard subscription at any time after the 4-month minimum commitment period has been completed. Cancellation takes effect at the end of your current billing cycle — you will not be charged for the following month.

There is no self-serve cancel button. We ask that you contact us directly so we can confirm your request, arrange hardware return, and ensure your service is properly deactivated.

Cancellation requests made during the 4-month minimum period will be assessed on a case-by-case basis. We are a small, family-run business and will always try to work with you fairly.

5. Limitation of Liability

Important: PhoneGuard is a detection aid, not a guarantee. No automated system can catch every scam, every time.

To the fullest extent permitted by applicable law, CloudTect and its operators shall not be liable for:

  • Any scam calls that are not detected or incorrectly assessed by the PhoneGuard system
  • Any financial loss, emotional distress, or damages arising from a call that was not flagged
  • Any legitimate calls that are incorrectly disconnected (false positives)
  • Any interruption to telephone service caused by hardware malfunction, power outage, or internet disruption
  • Any indirect, incidental, or consequential damages of any kind

PhoneGuard is designed to reduce risk, not eliminate it. Users should continue to exercise caution with unexpected calls, particularly those requesting money, personal information, or urgent action.

Our total liability to you in connection with your PhoneGuard subscription shall not exceed the total amount paid by you in the 3 months preceding any claim.

6. Service Availability

We make every effort to keep PhoneGuard running reliably, but we do not guarantee uninterrupted service. Maintenance, updates, or technical issues may occasionally affect availability. We will communicate planned downtime in advance where possible.

7. Acceptable Use

PhoneGuard is for residential use only. You agree not to tamper with, reverse-engineer, or resell the hardware or software. The service is intended for the protection of the household address on file.

8. Changes to These Terms

We may update these Terms from time to time. You will be notified by email of any material changes. Continued use of PhoneGuard after notice constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of London, Ontario.

10. Privacy Policy

CloudTect is committed to protecting your privacy in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). This Privacy Policy explains what information we collect, how we use it, and your rights.

11. Information We Collect

We collect the following information when you subscribe to PhoneGuard:

  • Personal information: Name, email address, phone number, and home address — provided during checkout
  • Payment information: Processed and stored securely by Stripe. We do not store your full card number
  • Call data: Caller ID, call duration, call direction, and scam confidence scores for all calls handled by your PhoneGuard device
  • Call recordings: Audio recordings of calls that exceed our scam confidence threshold (60%). These are stored securely in Canada
  • Device data: Technical status information from your PhoneGuard device (online/offline status, last active time)

12. How We Use Your Information

  • To provide, operate, and improve the PhoneGuard service
  • To send you service notifications, billing receipts, and support communications
  • To display your call history and recordings in your private family dashboard
  • To contact you regarding your subscription, hardware, or account

We do not sell, rent, or share your personal information with third parties for marketing purposes.

13. Call Recordings

PhoneGuard records audio only on calls that exceed our scam confidence threshold. Recordings are:

  • Stored on Canadian servers (Backblaze B2 — Canadian region)
  • Accessible only to your household through your password-protected dashboard
  • Retained for 90 days and then automatically deleted
  • Never shared with third parties, law enforcement, or advertisers without your explicit consent or a valid legal order

14. Third-Party Services

PhoneGuard uses the following third-party services to operate:

  • Stripe — payment processing (stripe.com/privacy)
  • AssemblyAI — real-time call transcription (assemblyai.com/privacy)
  • Backblaze B2 — secure audio file storage
  • Neon — database hosting
  • Cloudflare — web infrastructure and security
  • Brevo — transactional email delivery

Each of these providers has their own privacy policies. We only share the minimum data required for each service to function.

15. Your Rights (PIPEDA)

Under PIPEDA, you have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Withdraw consent and request deletion of your data (subject to legal and contractual obligations)
  • File a complaint with the Office of the Privacy Commissioner of Canada

16. Data Retention

We retain your personal information for as long as your subscription is active plus 12 months, after which it is deleted. Call recordings are deleted after 90 days. Payment records are retained as required by law.

17. Security

We take reasonable technical and organizational measures to protect your information, including encrypted storage, secure HTTPS connections, and access controls. No system is 100% secure — if you have concerns about a security issue, please contact us immediately.
